According to Article 33 of the Railway Law, the administrative acts (decisions) adopted by the officials of the State Railway Technical Inspectorate can be contested and appealed in writing within one month from the date of their entry into force, by submitting an application.
- An administrative act (decision) can be appealed in the following order:
- The administrative acts (decisions) of the senior inspectors of the State Railway Technical Inspectorate can be appealed by submitting an application to the Deputy Director of the State Railway Technical Inspectorate, the Head of the Traffic Safety Department of the State Railway Technical Inspectorate;
- Administrative acts (decisions) issued by the heads of the structural units of the State Railway Technical Inspectorate can be appealed by submitting an application to the Director of the State Railway Technical Inspectorate;
- Administrative acts (decisions) adopted by the Director can be appealed to an administrative court.
- The following shall be stated in the submission regarding of appealing of an administrative act (decision):
- which administrative act is appealed (contested);
- the extent to which the administrative act is appealed (contested) (in whole or in part);
- request.
In the application for the appeal an administrative act can also indicate the reasons for appealing the administrative act, as well as attach the evidence if necessary in your opinion.
The State Railway Technical Inspectorate will provide an answer to the application regarding the appeal of the administrative act (decision) within one month from the day of receipt of the application. If, due to objective reasons, it cannot be fulfilled within the above-mentioned term, the State Railway Technical Inspectorate is entitled to extend the term by informing the applicant.
The document containing a submission, request, complaint, proposal or question within the competence of the institution must contain information on the submitter (for a individual person - name and surname, as well as address and, if necessary, other information that helps to contact the applicant: for a legal entity - name and legal address). The State Railway Technical Inspectorate will provide an answer within one month from the date of receipt of the application, request, complaint, proposal or question.
Any application, including an appeal of an administrative act (decision), must be signed.
