Issuing of a permit for non-registrable rolling stock

In order to receive a permit for the use of the non-registrable unit, the user of the non-registrable unit (a natural or legal person who wishes to use the non-registrable unit in the railway system) shall submit to the Inspectorate a submission identifying the non-registrable unit and the planned use.

The application shall be accompanied by:

• the shall the manufacturer's declaration of conformity based on the relevant technical documentation. . Where the manufacturer's declaration of conformity is not available, compliance with the requirements of conformity may also be demonstrated by a report from the assessor on the application of the common safety method for risk assessment;
• the operating manual of the non-registrable unit, indicating its operating conditions and limitations, as well as repair and maintenance requirements;
• the shall an assessment of the regarding safe integration of the non-registrable unit into the user safety management system or established system, which is capable of ensuring the operation thereof in the relevant field of commercial activity in the railway sector, observing the regulations for technical operation of the railway and applying Regulation No.402/2013;
• results of checks carried out on railway infrastructure (if any).

The Inspectorate shall evaluate the completeness of the documentation and compliance with the requirements of the Regulations.

The user of the non-registrable unit, upon prior agreement regarding time and place, shall present the non-registrable unit to the inspection in working mode and transport state. The Inspectorate shall verify the validity and labelling of the non-registrable unit.

If the non-registrable unit complies with the specified requirements, the Inspectorate shall issue a permit regarding the use of the non-registrable unit, which shall indicate the user, manufacturer, identification of the non-registrable unit, conditions of use and restrictions of the non-registrable unit.
