The applicant shall establish a maintenance system for those vehicles for the maintenance of which it is in charge and ensure the safe operation of these vehicles.

  • The maintenance system shall be composed of the following functions:
    • system management function;
    • maintenance development function;
    • fleet-maintenance management function;
    • maintenance delivery function.

The system management function is to supervise and coordinate the implementation of all functions of the maintenance system. This function may not be delegated by the entity in charge of maintenance to other contractors.

The maintenance development function shall include activities that ensure the management of maintenance documentation, including the configuration management, based on design and operational data as well as on performance and return on experience. This function, or part of it, may be entrusted to other contractors.

The fleet-maintenance management function includes actions to ensure that the vehicle is taken out of service for maintenance and it is returned to operation after maintenance. This function, or part of it, may be entrusted to other contractors.

The maintenance function includes activities that ensure the required technical maintenance of the vehicle or its parts, including the issuance of documentation related to the release to service documentation. This function, or part of it, may be entrusted to other contractors.

In order to obtain the certificate of the entity in charge of maintenance for vehicles of 1520 mm track gauge, the applicant shall ensure the safe operation of vehicles through the vehicle maintenance system and shall demonstrate that the functions of the system set up by him meet the requirements and assessment criteria with regard to the functions it decided to outsource (entrusted to another contractor). Applicant shall submit an application to the State Railway Technical Inspectorate in compliance with the requirements specified in Paragraphs 58 and 59 of Regulation No. 375.

The State Railway Technical Inspectorate shall assess whether the applicant, as the entity in charge of maintenance for vehicles of 1520 mm track gauge, is able to meet the relevant requirements referred to in Paragraph 52 of Regulation No. 375 and apply them consistently, ensuring safe operation of the vehicles for which it is responsible.

If the holder of a certificate intends to change the operating conditions on the basis of which the certificate was issued, it shall notify the State Railway Technical Inspectorate thereof prior to the change of operating conditions. Within one month after receiving the information, the State Railway Technical Inspectorate shall assess the significance of the planned changes of the entity in charge of maintenance and, if they affect compliance with directly applicable European Union legislation, national rules or local infrastructure conditions, instruct the entity in charge of maintenance to make appropriate changes to its documents within one month and request to submit an application for amendment of the certificate. If the changes do not affect compliance with directly applicable European Union legislation, national rules or local infrastructure conditions, the State Railway Technical Inspectorate shall register the information as a change in the operating conditions of the certificate without amending the certificate.

If the holder of a certificate intends to continue operating as an entity in charge of maintenance for vehicles of 1520 mm track gauge, it not earlier than 12 months before the certificate expires shall submit an application to the State Railway Technical Inspectorate with a request to renew the certificate, adding the relevant documents specified in Paragraph 59 of Regulation No. 375.
